Colorado PERA Files Motion Challenging Ballot Initiative

PERA issued a news release on April 12 saying that it has filed a motion with the Colorado Title Setting Board at the Office of the Secretary of State challenging the 2-1 ruling of the Title Board earlier this month that approved the title of Initiative #93 called “PERA Reform.”

Elements of PERA’s motion for rehearing include:

  • The provisions of the initiative must comply with state statutes that require ballot initiatives to cover a single subject.
  • The title set by the Title Setting Board is misleading, inaccurate, or incomplete based on the content of Initiative #93

It is anticipated that the motion for rehearing will be heard by the Title Board on Wednesday, April 19. The motion was filed on PERA’s behalf by attorneys Mark G. Grueskin and Edward T. Ramey of the Denver law firm of Isaacson Rosenbaum, P.C.

Meanwhile, the proponents of the initiative filed a new initiative, numbered 106, that makes a few small changes that they intend to address the concern raised at the Title Setting hearing about section 2 of their measure and the lack of a single subject. The proponents asked that Legislative Council and Legislative Legal Services staff expedite the review and comment process on Initiative #106. 

Legislative Information Center Placed on PERA Web Site

PERA has revised its Web site (www.copera.org) to include a new “Legislative Information Center.”  The information can be found from PERA’s Home Page and includes info on legislation in the 2006 session affecting PERA as well as info on the motion filed by PERA (see above). There is also a “PERA Update” presentation that PERA has made to several employee and employer groups this spring.  Several editorial responses from PERA that have appeared in newspapers are on this site as well.

Also, you can click on “Legislative Action Center” and find information on candidates and on how to contact elected officials.

The PERA Ambassador Web site area will continue to be maintained and will have supplemental information on legislation, committee memberships, news articles on PERA, and other subjects.
